PromptSee

Copyright & DMCA

Welcome to PromptSee (promptsee.co.uk). PromptSee is an independent digital gallery and creative prompt directory founded by Hussain in the United Kingdom. We are dedicated to the exploration, cataloging, and education of generative artificial intelligence visual engineering.

We believe that technological innovation must exist in profound harmony with human artistic integrity. PromptSee maintains an uncompromising respect for the intellectual property rights of artists, photographers, illustrators, design studios, and copyright holders worldwide. We operate in strict conformity with:

  • The United States Digital Millennium Copyright Act (17 U.S.C. § 512, “DMCA”);
  • The United Kingdom Copyright, Designs and Patents Act 1988 (CDPA);
  • The European Union Directive (EU) 2019/790 on Copyright in the Digital Single Market; and
  • Global intellectual property and safe harbor conventions.

This Copyright & DMCA Policy outlines our operational principles regarding AI-generated media, visual previews, text prompt recipes, our formal takedown protocols, counter-notification processes, and our zero-tolerance stance toward repeat infringers.

PromptSee has designated a formal Copyright Agent to receive, investigate, and process notifications of claimed intellectual property infringement. All formal copyright claims, DMCA notices, and attribution requests must be directed to:

  • Platform Name: PromptSee (promptsee.co.uk)
  • Designated Copyright Agent: Hussain
  • Official Legal & Rights Inbox: info@promptsee.co.uk
  • Email Subject Requirement: [DMCA / Copyright Notice] - Specific URL or Asset
  • Governing Jurisdiction: England and Wales, United Kingdom

We recommend submitting all notices electronically via email for the most expeditious processing.

To ensure absolute transparency between PromptSee, creators, and legal rights holders, it is critical to delineate the nature of our directory:

2.1 The Nature of Prompt Formulas

PromptSee indexes, categorizes, and provides public access to textual prompt strings (linguistic formulas specifying camera bodies, focal lengths, lighting setups, color grading, and descriptive subject attributes). Under current legal frameworks across the United Kingdom, the United States, and the European Union, concise descriptive textual instructions and ideas are generally not copyrightable, functioning instead as conceptual recipes that guide neural networks.

2.2 Visual Sample Previews & Provenance

To demonstrate the visual potential of our prompt formulas, PromptSee features sample visual imagery. These previews originate from:

  1. Direct outputs generated across generative diffusion architectures (such as Midjourney, Flux.1, Stable Diffusion, DALL-E 3, and Leonardo AI);
  2. Royalty-free photographic references and public Content Delivery Network (CDN) archives; and
  3. Voluntary submissions by community prompt engineers who represent and warrant ownership of their shared outputs.

PromptSee does not intend, endorse, or willfully permit the unauthorized reproduction or distribution of copyright-protected human artwork. If any preview imagery hosted on or linked by our directory is found to conflict with an existing copyright, our policy is to review and remove or modify that asset immediately.

If you are a copyright owner, or an authorized agent acting on behalf of a copyright owner, and believe that any content hosted on promptsee.co.uk infringes upon your copyrighted work, you may submit a formal notification pursuant to 17 U.S.C. § 512(c) and the UK CDPA.

To be legally effective, your notice must be in writing and contain each of the following statutory elements:

3.1 Statutory Notice Checklist:

  1. Identification of the Copyrighted Work: A clear description of the copyrighted work you claim has been infringed. If multiple copyrighted works are covered in a single notification, provide a representative list of such works (including registration numbers or links to original publications where applicable).
  2. Identification of the Allegedly Infringing Material: Specific identification of the material on promptsee.co.uk that you claim is infringing, with sufficient detail to allow us to locate it. You must provide the exact, direct URL(s) (e.g., https://promptsee.co.uk/prompt/example-prompt-title/). Generic references to the website will delay our response.
  3. Contact Information: Accurate contact details enabling our legal desk to communicate with you, including:
    • Full Legal Name
    • Physical Mailing Address
    • Telephone Number
    • Valid Email Address
  4. Statement of Good Faith Belief: The following verbatim statement:

“I have a good faith belief that use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

  5. Statement of Accuracy under Penalty of Perjury: The following verbatim statement:

“I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or authorized representative (typing your full legal name at the bottom of the email constitutes an electronic signature).

Please transmit the completed notice to: info@promptsee.co.uk.

4. Our Rapid Response Protocol & Safe Harbor Compliance

Upon receipt of a formal, legally compliant notification of claimed infringement at info@promptsee.co.uk, PromptSee executes the following four-step protocol:

  1. Immediate Acknowledgment: Our legal desk will log the notice and confirm receipt within 24 hours.
  2. Expeditious Review & Disabling: If the notification satisfies the statutory criteria outlined in Section 3, we will act expeditiously to remove or disable access to the allegedly infringing material from promptsee.co.uk (typically within 24 to 48 business hours).
  3. Uploader Notification: If the material was submitted by a registered community creator, we will forward a copy of the takedown notice to that creator, advising them of the removal and informing them of their legal right to file a Counter-Notification.
  4. Record Archiving: Full audit logs of all DMCA notices and corresponding actions are archived to support our Repeat Infringer policy and statutory compliance records.

5. Counter-Notification Procedure

If content you submitted to PromptSee was disabled or removed as a result of a DMCA takedown notice, and you believe in good faith that the material was removed due to a mistake, misidentification, or fair use justification, you may submit a formal Counter-Notification pursuant to 17 U.S.C. §§ 512(g)(2) and (3).

5.1 Counter-Notice Requirements:

Your Counter-Notification must be sent in writing to info@promptsee.co.uk and contain:

  1. Identification of the specific material that was removed or disabled and the URL at which it appeared prior to removal.
  2. Your full legal name, physical address, telephone number, and email address.
  3. A statement under penalty of perjury:

“I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

  4. A consent to jurisdiction statement:
    • For UK and International Residents: “I consent to the jurisdiction of the courts of England and Wales for any judicial proceeding arising from this notification.”
    • For US Residents: “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or, if outside the US, for any judicial district in which PromptSee may be found), and I will accept service of process from the person who provided the original takedown notice or an agent of such person.”
  5. Your physical or electronic signature.

5.2 What Happens After a Counter-Notification is Filed:

Upon receipt of a valid Counter-Notification, PromptSee will forward a copy to the original complaining party. If the original complainant does not notify PromptSee within 10 to 14 business days that they have initiated court action seeking a restraining order against the content, PromptSee is statutorily permitted to restore the disabled material to the directory.

6. Repeat Infringer Policy

PromptSee strictly respects intellectual property laws and maintains a mandatory Repeat Infringer Policy.

In accordance with 17 U.S.C. § 512(i) and UK digital regulation:

  • Any user, community contributor, or account holder who is determined to have repeatedly uploaded infringing materials, or against whom multiple substantiated DMCA takedown notices have been filed, will face permanent termination of their submission privileges.
  • Their IP addresses may be blacklisted from submitting content to promptsee.co.uk.
  • PromptSee reserves the sole discretion to ban any contributor even upon a single flagrant, intentional act of intellectual property theft.

7. Alternative Resolution: Artist Attribution & Collaboration

We recognize that many creators and photographers do not wish to censor inspiration, but rather desire proper credit, digital attribution, and portfolio traffic.

If an asset featured on PromptSee was inspired by your creative photography or digital art, and you would prefer formal accreditation and backlinking rather than removal, our team will eagerly accommodate you.

Simply send an email to info@promptsee.co.uk with the subject [Attribution Request]:

  • Provide the prompt URL on promptsee.co.uk.
  • Provide your preferred display name, website, ArtStation, or social media link.
  • Our team will update the prompt card within 24 business hours to prominently feature your artist credit and external profile link.

We take pride in celebrating human artistry and championing original creators within the generative AI movement.

8. Warning Regarding Material Misrepresentation

Please evaluate your claim carefully before filing a formal notice. Under 17 U.S.C. § 512(f) and UK common law, any person who knowingly and materially misrepresents that online material is infringing (or that material was removed by mistake or misidentification) may be held liable for civil damages, court costs, and statutory legal fees incurred by the alleged infringer, the copyright owner, or PromptSee.

If you are uncertain whether the material you are reporting genuinely infringes upon your copyright (for instance, whether the use is protected under fair use, fair dealing, or public domain exceptions), we strongly advise seeking independent legal counsel prior to submitting a notice.
